BLOOD TRIBE/KAINAI EMERGENCY PROTECTION BYLAW NO. 04-2020 - PROOF OF VACCINATION REGULATION
Pursuant to their inherent authority and the Blood Tribe Emergency Protection Bylaw No. 04-2020, the Blood Tribe Council has enacted the Proof of Vaccination Regulation (the “Regulation”) and have directed that the Regulation be posted on the Blood Tribe Council website and come into force on November 1, 2021.
BLOOD TRIBE/KAINAI EMERGENCY PROTECTION BYLAW NO. 04-2020
Being a Bylaw of the Blood Tribe to provide for the health of residents on the Blood Indian Reserve Nos. 148 and 148A (“Blood Reserve”) and to ensure the observance of law and order on the Blood Reserve pursuant to Section 81 of the Indian Act.
KAINAI/BLOOD TRIBE TRESPASS BYLAW ENTRY & RESIDENCY PERMITS BYLAW NO. 03-2015
Being a Bylaw of the Blood Tribe to provide for the removal and punishment of persons trespassing on the Blood Indian Reserve Nos. 148 and 148A or for frequenting the Reserve for prohibited purposes pursuant to subsection 81(1)(p) of the Indian Act.
BLOOD TRIBE EMERGENCY MEASURES BYLAW BACKGROUND April 9, 2020
On April 6, 2020 Council exercised its powers and authority and passed the Blood Tribe/Kainai Emergency Protection Bylaw No. 04-2020. This Bylaw will allow Council to make regulations from time to time related to a number of emergency matters, both for the COVID-19 pandemic as well as future emergencies that may arise. Any regulations that are put into place under this Bylaw, such as the operation of an emergency plan, the requirement for a curfew, assigning responsibilities to Departments or Entities, funding for the reimbursement of costs, control of traffic on the Blood Reserve and other types of emergency regulations will be enforceable under the Bylaw. The Indian Act provides for Bylaws that are made pursuant to that Act to be immediately in force once the Bylaw is posted on the Blood Tribe Council website or in the community.
BLOOD TRIBE/KAINAI EMERGENCY PROTECTION BYLAW NO. 04-2020 CURFEW REGULATION
WHEREAS on April 17, 2023 the Blood Tribe Chief and Councillors (“Council”) declared a State of Emergency in relation to the opioid epidemic on the Blood Reserve; and AND WHEREAS the Chief and Council continue to combat the drug addiction crisis within Blood Reserve; AND WHEREAS there is a resurgence of dangerous drugs in the community and the harm to the health, safety and welfare of community members is escalating on a daily basis; WHEREAS on April 24, 2023 Council subsequently announced a curfew on the Blood Reserve in order to minimize the risk of harm arising from the opioid epidemic; and WHEREAS Council approved the Blood Tribe/Kainai Emergency Protection Bylaw on April 6, 2020; and WHEREAS the Blood Tribe/Kainai Emergency Protection Bylaw subsection 6.1 (k) provides the authority for Council to make regulations that impose a curfew on the Blood Reserve NOW THEREFORE the Blood Tribe Council passes a Curfew Regulation on the Blood Reserve for all ages to minimize the risk of harm arising from the opioid epidemic, which Regulation is attached to this BCR as Schedule “A”.
